(“Company,” “we” or “us”). MLMauction has created this Privacy
Policy in order to disclose our information gathering and dissemination practices. We understand the
importance that Internet users place on privacy and have designed our Site with this in mind. MLMauction is fully
committed to 100% permission-based marketing. You agree to this Privacy Policy, in its entirety, when
you: (a) access or use our Site; and/or (b) register as a Member (as that term is defined in the MLMauction Website
Terms and Conditions (the “Terms and Conditions”)), which provides you with access to: (i) the
auction-style Marketplace; (ii) User History (as defined below), which includes comments, feedback and ratings
regarding the Sellers and Buyers participating on the Site; and/or (iii) other MLMauction Services.
Please read the following to learn what information we collect from you (the “User” or the “End

Any capitalized
terms not defined herein shall have the meaning set forth in the Terms and Conditions.
1. Changes to Privacy Policy
If we decide to change our privacy policy, we will post those changes
to this privacy statement, the home page, and other places we deem appropriate so that you are aware of what
information we collect, how we use it, and under what circumstances, if any, we disclose it.
We reserve the right to modify this privacy statement at any time, so

2. Types of Information Collected and Uses of Collected Information
We collect two types of information about our Website Users:
Personally Identifiable Information and Non-Personally Identifiable Information.
Use of Personal Information: Any Personal Information that you submit at the Site remains your
property. However, by submitting that information to us, you grant to us the right to use your Personal
Information (other than Sensitive Information), subject to applicable state and federal law, for any legal purpose
including, without limitation: (a) marketing purposes, such as sharing or transferring your information (other than
Sensitive Information) with/to third-party advertisers; (b) providing promotional offers to you by means of e-mail
advertising, telemarketing, SMS text-based marketing (where and to the extent permitted by applicable law), direct
mail marketing, pop-ups, pop-unders and/or online banner advertising; (c) tracking compliance with
our Terms and Conditions and, if applicable, the MLMauction Seller
Agreement (“Seller Agreement”) ; and (d) for validation, suppression, content
improvement and feedback purposes. Without limiting the generality of the foregoing, we reserve the
right to share, sell, rent, lease and/or otherwise distribute any and all Personal Information (other
than Sensitive Information) with/to any third-party for any and all uses permitted by this Privacy Policy and
applicable law. MLMauction may disclose Personal Information to third-party agents and independent
contractors that help us conduct our marketing and survey efforts. You agree that we may contact you at
any time with updates and/or any other information that we may deem appropriate for you to receive in connection
with your continued use of the Site.
We also reserve the right to release current or past member/user information in the event that: (i) we
believe that the Site, Marketplace and/or (The Company) Services is/are being or has been used to commit
unlawful acts; (ii) if the information is subpoenaed or otherwise required in a court proceeding; (iii) in the
event that you violate or breach an agreement with MLMauction (iv) we believe that you will harm the property or
rights of MLMauction or those of MLMauction Members, partners and/or affiliates; (v) if we are sold or acquired; or
(vi) when we otherwise deem it necessary or appropriate.
By agreeing to this Privacy Policy, you hereby consent to disclosure of any record
or communication to any third-party when we, in our sole discretion, determine the disclosure to be appropriate
including, without limitation, sharing your e-mail address with other third-parties for suppression purposes in
compliance with the requirements of the CAN-SPAM Act of 2003, as amended from time to time
(“CAN-SPAM”).
By registering at the Site, you agree that such act constitutes an inquiry and/or application for
purposes of the Amended Telemarketing Sales Rule (16 CFR §310 et seq.), as amended from time to time (the
“Rule”) and applicable state do-not-call regulations. As such, notwithstanding that your
telephone number may be listed on the Federal Trade Commission’s Do-Not-Call List, and/or on applicable state
do-not-call lists, we retain the right to contact you via telemarketing in accordance with the Rule and applicable
state do-not-call regulations.
In addition, by submitting your Personal Information at the Site, you agree to receive mobile marketing
including, but not limited to, text-message based marketing, from us and our third party advertisers and marketers
(where, and to the extent that, such marketing is permitted by applicable law). As such,
notwithstanding that your mobile telephone number may be listed on state and/or federal Do-Not-Call
registries, we retain the right to contact you via text-message based marketing in accordance with applicable state
and federal law. Further, you agree that we reserve the right to share, sell, rent, lease and/or
otherwise distribute your mobile telephone and other mobile data with/to any third-party for any and
all non-marketing uses permitted by this Privacy Policy and applicable law.
Personally Identifiable Information: Personally Identifiable
Information is information that identifies a specific End User. When you engage in certain activities
on the Website, such as creating an account, ordering a product or service from us or our partners, submitting
content and/or posting content in discussion forums, entering a contest or sweepstakes sponsored by us or our
partners, filling out a survey, posting a review, sending us or our partners feedback, requesting information about
our services, submitting an affiliate agreement, applying for a job, posting a video or signing up for special
offers from third parties through the Website (collectively, “Identification Activities”), we may ask
you to provide certain information about yourself. It is optional for you to engage in an
Identification Activity. If you elect to engage in an Identification Activity, however, we may ask you
to provide us with certain personal information about yourself, such as your first and last name, mailing address
(including zip code), email address, telephone number and date of birth. When you order products or
services, we may also ask you to provide us with your credit card number, expiration date and authentication codes
or related information. Depending on the activity, some of the information we ask you to provide is
identified as mandatory and some is identified as voluntary. If you do not provide the mandatory
information for a particular activity that requires it, you will not be permitted to engage in that
activity.
Refer-A-Friend:
If you choose to use our referral service, we will automatically send your friend a one-time email with the gift
you bought for them or inviting him or her to visit the site. MLMauction stores this information for
the sole purpose of sending this one-time email, sending their gift and tracking the success of our referral
program.
Your friend may
contact us at support@MLMauction.com to request that we remove this information from our
database.
We use Personally
Identifiable Information to provide products and services to you, administer sweepstakes and contests, enhance the
operation of the Website, improve our marketing and promotional efforts, analyze Website use, improve our product
and service offerings, and to tailor your experience with third parties as provided in Item 3 of this Privacy
Policy. For example, if you send our customer service an email we may use your comments and feedback to
tell others about our services, and may post your comment in our marketing materials or on our Website.
Your comments may contain personal information such as your name, and we will obtain consent from you to post your
name along with your comment prior to posting your comment for public view. In addition, if you use our
Website to send information or a product to another person, we may store your personal information. We
may also use Personally Identifiable Information to troubleshoot, resolve disputes, accomplish administrative
tasks, contact you, enforce our agreements with you, including our Website Terms of Use and this Privacy Policy,
comply with applicable law, and cooperate with law enforcement activities.
Non-Personally Identifiable Information: Non-Personally Identifiable
Information is information that does not identify a specific End User. This type of information may
include things like the Uniform Resource Locator (“URL”) of the website you visited before coming to
our Website, the URL of the website you visit after leaving our Website, the type of browser you are using and your
Internet Protocol (“IP”) address. We, and/or our authorized Third Party Service Providers
and Advertisers, may automatically collect this information when you visit our Website through the use of
electronic tools like Cookies and Web beacons or Pixel tags, as described in Items 4 and 8 of this Privacy
Policy.
We use
Non-Personally Identifiable Information to troubleshoot, administer the Website, analyze trends, gather demographic
information, comply with applicable law, and cooperate with law enforcement activities. We may also
share this information with our authorized Third Party Service Providers and Advertisers to measure the overall
effectiveness of our online advertising, content, and programming.
3. Services
To accomplish our goal of fostering interaction between our Site’s Buyers and Sellers, making the
Marketplace valuable to Members, providing the MLMauction Services and providing other products and/or
services, we may need to gather personal information on the Membership application form, and other
registration forms, which may include, without limitation: your: (a) full name; (b) mailing address; (c)
e-mail address; (d) date of birth; (e) gender; (f) credit card number and associated information; (g) PayPal®
account information; and/or (h) any other information requested by us on the applicable registration
form (collectively, “Registration Data”). For purposes of this Privacy Policy, items
(f) and (g) in the preceding sentence shall be considered “Sensitive Information.” The
aforementioned Registration Data, together with information regarding your transactions with MLMauction (which may
include, but is not limited to, your payment history) is referred to collectively herein as “Personal
Information.” We may also collect your Personal Information when you otherwise agree to the terms
of this Privacy Policy at the Site, but do not complete the full registration process.
4. Release
of Personally Identifiable Information
We will not share, sell, rent, or trade your Personally Identifiable Information with other parties
except as provided below:
We may share your information with MLMauction Merchants. From time to time, we provide
offers from particular merchants (referred to as “The Company Merchants”) who, as part of the offer,
request information on MLMauction customers who purchased the offer in order to aid redemption. In
those cases, we share some of your Personally Identifiable Information with MLMauction Merchants.
Sharing this Information may allow a MLMauction Merchant to market directly to you should they choose to do
so. However, we will only share Personally Identifiable Information with a MLMauction Merchant if you
engage in an Identification Activity, and then only to the MLMauction Merchant involved in that Identification
Activity. We specifically disclaim any responsibility or liability for the actions of such MLMauction
Merchant. While we inform them that they are only permitted to communicate with you for the purposes of
the specific promotion with MLMauction, we do not have any responsibility for the actions of the MLMauction
Merchant, and the actions of the MLMauction Merchants are not in our control.
We may share your information with Authorized Third Party Service
Providers. We provide services and products through third parties. These “Third Party
Service Providers” perform functions on our behalf, like sending out and distributing our administrative and
promotional emails. We may share your Personally Identifiable Information with such Service Providers
to fulfill orders, deliver packages, send postal or email, administer contests or sweepstakes, remove repetitive
information on customer lists, analyze data, provide marketing assistance, provide search results and links,
process credit card payments, operate the Website, troubleshoot, and provide customer service. We may
also collect personal information from individuals and companies (“Affiliates”) with whom we have
business relationships and may share your information with Service Providers to accomplish our administrative
tasks. For example, when you order a service, we release your credit card information to the
card-issuing bank to confirm payment for the service and, if applicable, release your address to the delivery
service to deliver the service. Likewise, we may release an Affiliate’s information to our bank
to send out a payment. We encourage MLMauction Merchants and Third Party Service Providers to adopt and
post privacy policies. However, the use of your Personally Identifiable Information by such parties is
governed by the privacy policies of such parties and is not subject to our control.
We may remarket your information. Remarketing
is a way for us to connect with
users, based upon your past interactions with the MLMauction website. Third-party marketing vendors may
be hired by MLMauction to perform remarketing services. As a result, third-party vendors, including
Google, may show MLMauction ads on sites on the internet. Third-party vendors, including Google, use
cookies to serve ads based on a user's prior visits to MLMauction website. Users may opt out of
Google's use of cookies by visiting the Google advertising opt-out page at
http://www.google.com/privacy_ads.html. This information is used only for remarketing purposes and will not
be used by them for any other purpose.
Transaction E-mails: In order to facilitate communication regarding payment and shipment for the
Products featured in the auctions on the Site, the email address of each Winner will be made available to the
applicable Seller whose Product was featured in the subject auction and, in turn, the e-mail address of that Seller
shall be made available to the Winner. Where you participate in an auction on the Site, you agree that
your e-mail address may be shared with the applicable: (a) auction Winner where you are a Seller; and (b)
Seller where you are the auction Winner. E-mail messages that you receive from Sellers and/or Buyers
may contain comments, opinions, information and other content that is provided directly by such Sellers and/or
Buyers. MLMauction shall have no obligations and incur no liabilities to you or any other Members in
connection with any such comments, opinions, information and/or other content appearing within such e-mail
messages. Further, MLMauction has no responsibility or liability relating to the security measures
taken, and any use of your e-mail address, by any applicable Buyer and/or Seller.
We may share your information in a Business Transfer. As
with any other business, we could merge with, or be acquired by another company. If this occurs, the
successor company would acquire the information we maintain, including Personally Identifiable
Information. However, Personally Identifiable Information would remain subject to this Privacy
Policy.
We may share your
information for our Protection and the Protection of Others. We reserve the right to disclose your
personally identifiable information as required by law and when we believe that disclosure is necessary to protect
our rights and/or comply with a judicial proceeding, court order, or legal process served on our Website; enforce
or apply this Privacy Policy, our Website Terms of Use or other agreements; or protect the rights, property or
safety of the Website, its Users or others.
Use of Sensitive Information: To the extent
that MLMauction collects your credit card, bank account and/or PayPal®-specific information, if ever, we will
use that information to process and complete any MLMauction Service-related transactions that you request.
By submitting your credit card information to us, you authorize MLMauction to periodically verify that your
credit card account continues to be a valid and active one by charging, and thereafter immediately crediting, a
small sum to the card. Such verification may be conducted through a third-party and, in that case, MLMauction would
share your specific credit card information with this third-party for verification purposes. Apart from
said uses, we will not share your credit card information with any third-parties (other than as set
forth above and with consumer credit agencies) without your prior informed
consent. Notwithstanding the foregoing, MLMauction reserves the right to share with third-parties the fact that we
have credit card information on file for specific users, but we will not share your specific credit card
information with third-parties without your prior informed consent.
5. User History
As part of the MLMauction Services, after a Buyer has purchased a Product from a Seller via an
auction on the Site, the Buyer and Seller involved in the transaction can assign ratings (“Ratings”) to
the other, as well as enter comments regarding their experience (“Feedback” and together with the
Ratings, “User History”). Only a Buyer and Seller directly involved in a transaction
together can provide User History with respect to the other. User History is not designed for any
purpose other than for facilitating transactions between Buyers and Sellers. If you provide User
History on the Site, you should be aware that any personally identifiable information that you submit there can be
read, collected or used by other users of these forums, and could be used to send you unsolicited messages.
We are not responsible for the personally identifiable information that you choose to submit in connection
with User History.
6. Non-Personal Information
We automatically track certain non-personally identifiable information based upon your behavior on the
Site. This non-personally identifiable information may include the URL that you just came from, your
computer browser information and your Internet Protocol (“IP”) address. Your IP address is
a unique Internet “address” which is assigned to you by your Internet Service Provider
(“ISP”). While the IP address does not identify an individual by name, it may, with the
cooperation of the ISP, be used to locate and identify an individual using the Internet. Your IP
address can, however, reveal what geographic area you are connecting from, or which ISP you are using.
Finally, the other websites that you visit have IP addresses, and we may collect the IP addresses of those websites
and their pages, as well.
We use the non-personally identifiable information that we collect to improve the design and content of
our Site and to enable us to personalize your Internet experience. We also may use this information in
the aggregate to analyze Site usage, as well as to offer you products and services. We may share with
third-parties certain Site usage information for the purpose of tracking the performance of the
Marketplace, MLMauction Services, other Site functions and upgrading visitor information used in reporting
statistics. For this purpose, we may track some of the pages that you visit at our Site through the use
of pixel tags (also called clear gifs). By submitting information at and/or registering at the Site,
you agree to allow us to share such Site usage information with third-parties. We also may use
“cookies” to enhance your experience in using our Site. Cookies are text files that we
place in your computer's browser to store your preferences.
We use cookies to understand Site usage, to personalize your experience and to
improve the Marketplace, MLMauction Services and other offerings on our Site. To find out more

the above website for specific browser disabling information. Where a user rejects a cookie, he or she
may not be able to access and/or use all features on the Site.
7. Release of Non-Personally Identifiable Information
We may disclose or share Non-Personally Identifiable Information with
Partners, Affiliates and Advertisers. For example, we may share aggregated demographic information (which
does not include any Personally Identifiable Information) with “Third Party Advertisers” or
“Third Party Advertising Companies” and other parties as provided below:
We use Third Party Advertising Companies to serve ads when you visit
our Website. These companies may use Non-Personally Identifiable Information about your visits to this and
other websites in order to provide, through the use of network tags, advertisements about goods and services that
may be of interest to you. Some of these Third Party Advertising Companies may be advertising networks that
are members of the Network Advertising Initiative (“NAI”). If you would like more information

We also use Third Party Service Providers to track and analyze Non-Personally
Identifiable usage and volume statistical information from our Users to administer our Website and constantly
improve its quality. We may also publish this information for promotional purposes or as a representative
audience for Advertisers. Please note that this is not Personally Identifiable Information, only general
summaries of the activities of our Users. Such data is collected on our behalf, and is owned and used by
us.
8. Updating
and Correcting Information
We believe that you should have the ability to access and edit the Personally Identifiable Information
you provide us. You may change any of your Personally Identifiable Information by logging into your account
and accessing the "my account" section of the site, sending us an email at support@MLMauction.com or
writing to us at PO Box 2420, Lexington, SC 29071-2420. Please indicate your name, address and email
address, and what information you would like to update when you contact us.
We encourage you to promptly update your Personally Identifiable Information if it
changes. You may ask to have the information on your account deleted or removed; however, because we keep
track of past transactions, you cannot delete information associated with past transactions on the Website.
In addition, in may be impossible for us to completely delete all of your information because we periodically
backup information.
If you choose to store credit card or bank account information on the site, this is stored on a secure
page and you may delete your credit card information at any time by going to the "my account" section of
your profile.
9. User
Choices on Collection and Use of Information
As discussed above, you can always choose not to provide information, although it may be required to
engage in a certain activity on the Website.
As a condition of purchase of our products and services, we will send you Administrative and Promotional
emails. We will send you information regarding your account activity and purchases as well as updates about
our products and promotional offers. You cannot opt-out of Administrative Emails. “Administrative
Emails” relate to a User’s activity on the Website, and include emails regarding a particular
User’s account, requests or inquiries, and purchases of products and services. In contrast to
Administrative Emails, however, you do have a choice with respect to Promotional Emails. Promotional Emails
advertise our products and services, including exclusive sales and other offers, and/or the products and services
of our Advertisers and Affiliates. If you do not want to receive Promotional Emails from us, you may elect to
opt-out of receiving Promotional Emails at any time after registering by e-mailing us at support@MLMauction.com, by
writing to us at the address contained herein, or by hitting the “unsubscribe” button at the bottom of
any of our e-mails. When contacting us, please indicate your name, address, email address, and what
Promotional Emails you do not want to receive.
10. Security of Information
We take security seriously and take numerous precautions to protect the security of Personally
Identifiable Information. You can access your Personally Identifiable Information on our Website through a
password and your email address. This password is encrypted. We recommend that you do not share your
password with anyone. In addition, your Personally Identifiable Information resides on a secure server that
only selected personnel and contractors have access to. We encrypt certain sensitive information (such as
credit card information) using Secure Socket Layer (SSL) technology to ensure that your Personally Identifiable
Information is safe as it is transmitted to us.
Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be
100% secure. As a result, while we employ commercially reasonable security measures to protect data and seek
to partner with companies which do the same, we cannot guarantee the security of any information transmitted to or
from the Website, and are not responsible for the actions of any third parties that may receive any such
information.
Our employees are
dedicated to ensuring the security and privacy of all MLMauction users’ Personal Information.
Employees not adhering to our security policies are subject to disciplinary action. In compliance
with applicable federal and state law, we shall notify you and any applicable regulatory agencies in the event that
we learn of an information security breach with respect to your Personal Information. You will be
notified via e-mail in the event of such a breach. Please be advised that notice may be delayed in
order to address the needs of law enforcement, determine the scope of network damage and to engage in remedial
measures.
11. Data Tracking
Cookies: To facilitate and customize your experience with the Website, we store cookies on your
computer. A cookie is a small text file that is stored on a User’s computer for record-keeping purposes
which contains information about that User. We use cookies to save you time while using the Website, remind
us who you are, and track and target User interests in order to provide a customized experience. Cookies also
allow us to collect Non-Personally Identifiable Information from you, like which pages you visited and what links
you clicked on. Use of this information helps us to create a more user-friendly experience for all
visitors. In addition, we may use Third Party Advertising Companies to display advertisements on our
Website. As part of their service, they may place separate cookies on your computer. We have no access

Other Tracking Devices: We may use other industry standard technologies like pixel tags and web
beacons to track your use of our Website pages and promotions, or we may allow our Third Party Service Providers to
use these devices on our behalf. Pixel tags and web beacons are tiny graphic images placed on certain pages
on our Website, or in our emails that allow us to determine whether you have performed a specific action.
When you access these pages or open or click an email, pixel tags and web beacons generate a Non-Personally
Identifiable notice of that action. Pixel tags allow us to measure and improve our understanding of visitor
traffic and behavior on our Website, as well as give us a way to measure our promotions and performance. We
may also utilize pixel tags and web beacons provided by our Affiliates and/or Marketing Partners for the same

MLMauction reserves the right to transfer and/or sell aggregate or group data about MLMauction users for lawful
purposes. Aggregate or group data is data that describes the demographics, usage or other
characteristics of MLMauction users as a group without disclosing personally identifiable information.
Subject to applicable state and federal law, by submitting your Personal Information to, and/or using the Site, you
agree to allow MLMauction to transfer and/or sell such aggregate data to third-parties.
13. Privacy Policies of Third Party Websites
This Privacy Policy only addresses the use and disclosure of
information we collect from you on www.MLMauction.com. Other websites that may be accessible through this
Website have their own privacy policies and data collection, use and disclosure practices. If you link to any
such website, we urge you review the website’s privacy policy. We are not responsible for the policies
or practices of third parties.
In some cases, you may be able to make a purchase through or from one of these third-parties.
In these instances, you may be required to provide certain information, such as a PayPal® information,
credit card number, bank account information and/or shipping address, to register or complete a transaction with
such third party. These third-parties and/or third-party websites have separate privacy and data
collection practices and MLMauction has no responsibility or liability relating to them. We do not
endorse, nor are we responsible for the accuracy of, the privacy policies and/or terms and conditions of each
Buyer, Seller or third-party advertiser that may advertise at the Site. The Buyers, Sellers and
entities that advertise and/or place banner ads at the Site are independent third-parties and are not affiliated
with us.
14.
Miscellaneous Privacy Issues
Children and Minors under the age of 18 may not use the Website. We do not knowingly collect
personal information from anyone under the age of 18, and no part of the Website is designed to attract anyone
under the age of 18. MLMauction does not sell products for purchase by children. In certain
instances, we sell children's products for purchase by adults.
Public Areas: We may provide areas on our Website where you can publicly post
information about yourself, can communicate with others such as discussion boards or blogs, or can review products,
restaurants, and submit media content. This information may be accessible by other consumers and
companies and may appear on other websites or web searches, and therefore this information could be read,
collected, and used by others. For example, if you post your email address along with a public
restaurant review, you may receive unsolicited messages. We have no control over who reads your
postings or what other users may do with the information you voluntarily post, so please use caution when posting
any personal information. We do obtain consent from our users to post their name along with their
reviews.
Notice of Privacy
Rights to California Residents:

we provide you with a summary of your privacy rights under the California Online Privacy Protection Act (the
